1. Agreement to Terms

By accessing and using MyTip's digital tipping platform and mobile application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms apply to all users of the MyTip platform, including customers, service workers, and business partners.

2. Description of Service

MyTip is a digital tipping platform that enables customers to send tips to service workers through QR code scanning and digital wallet transactions. Our services include:

  • Digital wallet management for customers and service workers
  • QR code generation and scanning for tip transactions
  • Payment processing and fund transfers
  • Transaction notifications and history
  • Group tipping and tip splitting functionality
  • Customer support and dispute resolution

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your information remains current and accurate

3.2 Identity Verification

In compliance with South African financial regulations, we require identity verification for all users. This may include:

  • Government-issued ID verification
  • Banking information confirmation
  • KYC (Know Your Customer) documentation
  • Proof of address verification

3.3 Account Eligibility

You must be at least 18 years old and legally able to enter into contracts to use our services. Business accounts require additional verification and documentation.

4. Financial Terms and Wallet Management

4.1 Digital Wallet

Your MyTip wallet is not a bank account but a prepaid facility for storing funds to send tips. Wallet terms include:

  • Funds can be added via bank transfer, card payment, or mobile money
  • Minimum and maximum transaction limits apply
  • Funds do not earn interest
  • Wallet balances are protected but not insured by deposit insurance

4.2 Transaction Fees

MyTip charges the following fees:

  • Customer Transactions: No fees for sending tips
  • Wallet Loading: Standard payment processor fees may apply
  • Worker Withdrawals: Free standard bank transfers (3-5 business days)
  • Instant Transfers: Small fee for immediate transfers
  • International Transfers: Additional fees for cross-border transactions

4.3 Refunds and Reversals

Tips sent through MyTip are generally final. Refunds may be processed in limited circumstances:

  • Technical errors or system malfunctions
  • Fraudulent transactions
  • Merchant disputes within 24 hours
  • Mutual agreement between parties

5. Acceptable Use Policy

5.1 Permitted Uses

You may use MyTip only for lawful purposes, including:

  • Sending tips to service workers
  • Receiving tips for legitimate services provided
  • Managing your digital wallet
  • Accessing transaction history and reports

5.2 Prohibited Activities

You may not use MyTip for:

  • Money laundering or terrorist financing
  • Tax evasion or avoidance
  • Gambling or illegal activities
  • Circumventing transaction limits
  • Creating multiple accounts to avoid restrictions
  • Interfering with our systems or other users
  • Reverse engineering or unauthorized access attempts

6. Service Worker Terms

6.1 QR Code Usage

Service workers who display MyTip QR codes agree to:

  • Use QR codes only for legitimate tip collection
  • Display codes prominently and appropriately
  • Not share or duplicate codes unauthorized
  • Report any misuse or technical issues

6.2 Tax Responsibilities

Service workers are responsible for:

  • Reporting tip income to SARS (South African Revenue Service)
  • Maintaining accurate records of earnings
  • Complying with all applicable tax laws
  • Seeking professional tax advice when needed

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

8. Intellectual Property

MyTip and its content, including but not limited to text, graphics, logos, and software, are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without authorization
  • Reverse engineer our software or systems
  • Create derivative works based on our platform

9. Service Availability and Modifications

9.1 Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Third-party service issues
  • Regulatory requirements

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue our services at any time with reasonable notice. We may also update these terms and will notify you of material changes.

10. Limitation of Liability

To the maximum extent permitted by law, MyTip shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Third-party actions or failures
  • Force majeure events beyond our control

Our total liability for any claim shall not exceed the amount of fees paid by you in the 12 months preceding the claim.

11. Dispute Resolution

11.1 Customer Support

For any issues or disputes, please first contact our customer support team. We aim to resolve most issues quickly and fairly.

11.2 Mediation and Arbitration

If a dispute cannot be resolved through customer support, it may be subject to mediation or arbitration in accordance with South African law.

11.3 Legal Proceedings

Any legal action related to these terms must be filed within one year of the cause of action arising and shall be governed by South African law.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting customer support. Upon termination:

  • You may withdraw remaining wallet funds
  • Your account data will be retained as required by law
  • You remain responsible for any outstanding obligations

12.2 Termination by MyTip

We may terminate or suspend your account if you:

  • Violate these terms of service
  • Engage in fraudulent or illegal activities
  • Fail to complete identity verification
  • Remain inactive for an extended period

13. Regulatory Compliance

MyTip operates in compliance with South African financial services regulations, including:

  • Financial Intelligence Centre Act (FICA)
  • National Payment System Act
  • Consumer Protection Act
  • Protection of Personal Information Act (POPIA)

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MyTip. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.

By continuing to use our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
